Second Chance Dance: Waiver, Release of Liability, Privacy Policy, & Terms of Service

Waiver and Release of Liability:

Please read this document carefully before participating in any classes or activities at Second Chance Dance (SCD).

Assumption of Risk:

I, the undersigned, understand and acknowledge that participation in dance activities at SCD involves inherent risks of injury, including, but not limited to, muscle strains, sprains, ligament tears, fractures, head injuries, and other physical harm. I further acknowledge that these risks are present regardless of the precautions taken by SCD and its instructors. I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any activity or class while at, or under the direction of SCD.

Release and Hold Harmless:

In consideration of being allowed to participate in dance activities at SCD, I hereby release, waive, discharge, and hold harmless SCD, its owners, instructors, employees, agents, successors, and assigns from any and all claims, demands, losses, damages, liabilities, costs, and expenses (including attorneys’ fees) of any nature whatsoever arising out of or in any way connected with my participation in SCD’s activities, even if caused by the negligence of SCD or its instructors. Release: In consideration of the above-mentioned risks and hazards and in consideration of the fact that I am willingly and voluntarily participating in the activities offered by SCD. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.

Medical Consent and Emergency Authorization:

I acknowledge that I am in good physical health and condition and capable of participating in dance activities at SCD. I authorize SCD to seek emergency medical treatment for me in the event of injury or illness, and I agree to be responsible for all associated costs.

Health Insurance:

I certify that I have adequate health insurance to cover any medical expenses incurred as a result of my participation in SCD’s activities.

Indemnification: I, the participant, recognizes that there is risk involved in the types of activities offered by SCD. Therefore the I accept financial responsibility for any injury that the I may cause either to myself, or to any other participant due to my negligence. Should the above-mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless SCD, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by SCD. This includes but is not limited to the Chestnut Hill studio and Frankford Ave studio.

Photography and Videography Release:

I grant SCD the right to photograph and/or videotape me (he rights of my image, in video or still and of the likeness and sound of my voice as recorded on audio or video tape, without payment or any other consideration) during my participation in its activities and to use such photographs and/or videotapes for promotional, marketing, and educational purposes. I give permission for my photography/video to be used for publicity and advertising in the studio, on the website, social media, and in the community. I understand that my video may be edited, copied, exhibited and published and I waive the right to inspect or approve the finished product. Additionally, I waive my right to royalties or other compensation arising or related to the use of my image or recording.

Assumption:

I understand that SCD has the right to refuse entrance to the facility or use of any equipment and has the right to ask me to leave the premises if I appear under the influence or am in any way threatening, abusive, or act in an inappropriate way to any persons or property. I agree to be responsible for any damage or loss I cause to persons or property while at, in or around SCD premises.

Binding Agreement:

This Waiver and Release of Liability Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written. This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
